Standard Terms and Conditions
These are the standard terms and conditions (Terms) that apply to your subscription to Success Publishing Pty Ltd print and digital magazine published under the name and style of ‘Forbes Australia’ and other services and entitlements. Any reference in these Terms to ‘We’, ‘Us’ or ‘Success Publishing Pty Ltd’ is a reference to ‘Forbes Australia’.
Ensure you read the Terms specific to your subscription before making payment for any subscription. Once your payment has been processed, you are deemed to have accepted each of the Terms, as amended from time to time, and your payment becomes non-refundable.
1. Your Subscription
(a) We offer three types of membership plans:
(i)”Essential” which includes:
- 1 year unlimited Digital subscription to forbes.com.au; and
- A weekly newsletter from the Forbes editorial team.
Payment Term: Prepaid Annual at $199 AUD (billed annually);
(ii) “Premium” which includes:
- 1 year unlimited Digital subscription to forbes.com.au and a weekly newsletter from the Forbes editorial team;
- 1 year print magazine subscription (6 issues) with each new issue delivered to your nominated mailing address every 2nd month;
- Editor-in-Chief’s top picks and curated content;
- early access to iconic Lists and feature stories at the Editor’s discretion; and
- advanced invitations to VIP events and experiences.
Payment term: Prepaid Annual at $299 AUD (billed annually)
(iii) “Forbes Women” which includes:
- 1 year Premium subscription as noted in point (ii) valued at $299;
- invitations to attend 4 x quarterly soirees held by Forbes Australia;
- a monthly curated newsletter highlighting Forbes Women feature content and businesses.

(b) Forbes Australia and any of its related companies may require that users of our digital services become a registered user and create an account to access any such service or any other of our offerings from time to time.
(c) To subscribe to a membership plan, you must complete the online registration form and pay the relevant membership fee. We reserve the right to reject any application for subscription. Confirmation of acceptance will be provided to you via your nominated email address.
(d) You may pay by credit card or debit card at the time of subscription. If you pay by credit card, we may add a credit card surcharge (currently 0.5% but subject to annual review) which reflects the cost to us of processing your acceptance and payment.
(e) Subscription fees are not refundable except in the circumstances expressly set out in these Terms.
(f) We are not responsible and have no liability for any claim relating to any loss to you arising from you having entered incorrect contact details in your subscription process. It is your responsibility to report any errors to us as soon as you become aware thereof. In our absolute discretion, we may provide you with a credit to mitigate any such loss. Credit may (at our election) take the form of an extension to your subscription period or a reduction in the price of your next subscription payment.
(g) Your subscription affords you the entitlements described in your relevant membership plan for the duration of your subscription period, upon expiry of which your entitlements will cease.
(h) Your subscription is for your personal use only. You are not permitted to use your subscription for any commercial purpose, including to on-sell your subscription to any third party. If you wish to obtain a multiple user subscription, you may qualify (and must apply) for a corporate subscription. Please enquire from our Corporate Team for more information: info@concierge.forbes.com.au.
(i) Note that unless you cancel in accordance with section 5 your subscription will not terminate at the end of your subscription period but will automatically renew for the same period at the end of each billing cycle (i.e. year on year) in accordance with the terms and conditions of the subscription you select as part of your online purchase as stated on our website. On the last date of a subscription period (Renewal Due Date), you will be automatically charged for the next subscription period unless you have given prior notice to cancel your subscription (see section 5). We will notify you of the automatic renewal for the next subscription period at least 30 days prior to renewal. In respect of existing members, failure to pay any renewal by the Renewal Due Date may result in suspension or cancellation of access and all subscription benefits. Where access is suspended for non-payment, the subscription term is not extended for the period of suspension.
(j) It is also your responsibility to check your credit card and bank account statements to make sure that the correct amounts are being debited from your account and to let the Concierge Team know if you believe you are being billed incorrectly.
(k) We may change the frequency of issue or our pricing and fees at any time. We will give you at least 14 days’ notice if frequency is increased or the new price is greater than the price payable by you at the commencement of your current subscription period. If you have a fixed term subscription, the increased frequency and/or new price will be shown in your renewal notice. If you have an auto-renew subscription, the increased frequency and/or new price will be notified to you by email.
(l) Any increase in frequency or price will apply with effect from the next billing date after notice of such increase. If you cancel your subscription (not less than 7 days) before the next billing date, then the increase in frequency or price will not affect you (see section 5 below).
(m) To the extent permitted by law, we will not be liable to you for any loss or damage that you or any other person may incur in connection with your subscription, whether direct, indirect, consequential or otherwise. Furthermore, to the extent permitted by law, our maximum liability to you directly or indirectly in relation to your subscription is limited to the amount that is equal to the aggregate subscription fees paid by you to us in the 12-month period immediately preceding any claim.
2. Conditions of Access
(a) You will be entitled to receive the benefits of your membership package and any relevant online access once your application for subscription and the appropriate payment has been received and accepted by us (Registered Access). Confirmation of payment and acceptance will be provided to you by notice to your nominated email address.
(b) Your nominated email address is also your username to access the website. This provides you with single user access only, and can be used on no more than three devices concurrently. You must ensure that your username remains secure. Access to the website is verified by a token link and/or unique code sent to your email address.
(c) You are responsible for all use, activities and charges associated with your username. Your username and password are not transferable (to another user).
(d) Your Registered Access may be used for non-commercial purposes only.
(e) You must contact Forbes Australia if you become aware that unauthorised use of your account has occurred. Forbes Australia may take appropriate action, such as terminating registration if you are deemed to have shared your password outside your household or have allowed unauthorised use of your username and password.
3. Content
(a) We reserve the right to modify the content, inclusions, type and availability of any digital product at any time. We also reserve the right to enable free access to part or all of our magazines, periodicals, other content and services from time to time and you will not be entitled to any refund (whether full or partial) of your subscription fees if we do this.
(b) You acknowledge and agree that some of our content may be geographically restricted and accordingly may not be viewable or accessible from outside Australia. There may also be other technology or infrastructure related reasons which limit your ability to access our content at any time. You will similarly not be entitled to any refund (whether full or partial) of your subscription fees in such instances.
4. Managing your subscription and account
(a) You can manage your account, change your personal details in the My Account section of our customer portal or by contacting the Concierge Team via info@concierge.forbes.com.au for help.
(b) Upgrades may not be done online. You may upgrade your membership package at any time by contacting the Concierge Team via info@concierge.forbes.com.au. However, unless any upgrade is paid for immediately, any change will only take effect from your next billing cycle . If you have a print product, we will need up to 10 working days to make the change to your home delivery.
(c) You are responsible for making sure your delivery and payment details are always valid and up to date – you can do this online – visit My Account or contact the Concierge Team via info@concierge.forbes.com.au.
5. Cancellation and Termination
(a) You may cancel your subscription at any time directly through your account on the ‘MyForbes’ portal, or by contacting our Concierge Team at info@concierge.forbes.com.au. Cancellation will not take effect until the end of your current billing cycle
(b) In our discretion (acting reasonably), we may cancel or suspend your subscription at any time, such as any payment due by you being declined or if you otherwise breach any of these Terms . If we cancel your subscription (other than due to your breach of these Terms), we may give you a prorated refund provided you have prepaid your subscription in full. Opting out of marketing, newsletters or any other email communications otherwise related to your subscription does not constitute cancellation of your subscription.
(c) Irrespective of the reason for early termination of your subscription, you will not be entitled to a refund in respect the unexpired portion of your subscription period but will continue to enjoy all benefits under your membership plan until your subscription terminates
(d) We are not responsible for any missed or unwanted deliveries or any unexpected charges resulting from requests made by you to any newsagency or other third party rather than directly to our Concierge Team.
6. Privacy
(a) You acknowledge and agree that certain personal information (which may include your name, address, email address, year of birth, postcode and mobile/telephone) number may be collected and stored by us and, amongst other things, used to manage your subscription, communicate with you about your subscription and to notify you of any associated customer offers or benefits, future subscriptions and/or other goods and services that we consider you may be interested in, unless you specifically opt out of these communications by checking the appropriate ’opt out’ box.
(b) Information on how we handle your personal information is detailed in our Privacy Policy. By becoming a member, you acknowledge and agree that your data is collected and processed in accordance with the Forbes Australia Privacy Policy, and may be used for membership administration, event communications, subscription delivery and member experiences. 7. Data Security
Forbes Australia strives to ensure the security, integrity and privacy of personally identifiable information of our customers. We use a variety of physical and electronic security measures including restricting physical access to our offices and firewalls and secure databases to keep personal information secure from misuse, loss or unauthorised use or disclosure. No data transmission over the Internet or storage can be guaranteed to be totally secure.
8. Intellectual Property
(a) All intellectual property in relation to content on the Forbes Australia website (the Website), any website belonging to Forbes Australia or any of its related companies) and in the Forbes Australia Magazine and any other Forbes Australia publication (Forbes Content) belongs to Forbes Australia or its related company, licensor(s), advertisers or affiliates. You obtain no interest in that intellectual property. All Forbes Content is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the content.
(b) You may download and view content or print a copy of material on the Website for personal, non-commercial use provided you do not modify the content in any way (including any copyright notice). All rights not expressly granted under these Terms are reserved by Forbes Australia. Unless expressly stated otherwise, you are not permitted to copy, or republish anything you find on the Website without the copyright or trademark owners’ permission.
(c) Unless otherwise indicated, the logos on the Website and the logos on any other digital or paper media published or issued by us from time to time are registered trademarks of Forbes LLC used under license from Forbes LLC. Other trademarks may be displayed on the Website from time to time. These may belong to Forbes Australia or to third parties. Nothing displayed on the Website should be construed as granting any licence or right of use of any logo, trademark or masthead displayed on or within the Website, without the express written permission of the relevant owner.
9. Liability & Indemnity
Forbes Australia does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (ACL) which cannot be excluded, restricted or modified. However, Forbes Australia excludes all other rights, remedies, guarantees, conditions, and warranties in respect of your Registered Access, any membership or subscription or this Website, whether based in statute, common law or otherwise to the extent permitted by law. To the fullest extent possible and subject to Forbes Australia’s liabilities and obligations under the ACL:
(a) Forbes Australia and its related entities do not warrant the accuracy of the content on the Website. The content is provided to you “as is” and on an “as available” basis and on the condition that you undertake all responsibility for assessing the accuracy of the content and rely on it at your own risk;
(b) All content on the Website may be changed at the sole discretion of Forbes Australia and its related entities without notice except that if Forbes Australia materially changes the content which you access through your Registered Access or any membership or subscription so that the breadth or nature of the service you receive is materially altered, Forbes Australia will take the steps as described in these Terms to notify you of those changes, where practicable.
(c) Forbes Australia and its related entities will have no responsibility or liability in relation to any loss or damage that you incur, including damage to your software or hardware, arising from your Registered Access, any membership or subscription, any membership to our digital services or your use of or access to the Website or any related Forbes Australia website.
(d) Forbes Australia and its related entities do not warrant that functions contained in the Website, such as hyperlinks, will be uninterrupted or error free, that defects will be corrected or that Forbes Australia or the server that makes it available, are free of viruses or bugs.
10. Delivery of magazine
Your Forbes Australia Magazine is included in the Premium Membership and will be delivered within 60 days of the commencement of your membership. The Magazine will be mailed to the postal address listed in your ‘MyForbes’ portal. Please ensure this is your correct postal address. Premium members will receive the magazine every 2 months (we are a bi-monthly magazine).

Membership type: Individual annual membership
1. Definitions and interpretation
In these Terms:
- “ACL” means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth)
- “Activation Date” means the date of your Online Purchase.
- “Business Days” means a day that is not a Saturday, Sunday or public holiday in Sydney, New South Wales.
- “Fees” means the membership fees for the subscription option you select when making your Online Purchase as set out on the Forbes Women Membership website.
- “Forbes”, “we”, “us” means Success Publishing Pty Ltd trading as Forbes Australia.
- “Member”, “you” means the individual named as the member when making the Online Purchase.
- “Membership Term” means the 12-month period from the Activation Date.
- “Premium Subscription” means the Premium Subscription to Forbes Australia included in your membership, comprising access to subscriber website content and the printed magazine.
- “Online Purchase” means the online registration and purchase of Forbes Women Membership completed through the Forbes Australia website.
- “Terms” means these Forbes Women Membership terms and conditions.
Headings are for convenience only and “includes” is not a word of limitation.
2. Membership
Forbes Women Membership is issued on an individual, non-transferable basis and is valid for the Membership Term commencing on the Activation Date. Membership benefits apply only to the named Member and may not be shared, sublicensed or transferred, except by way of a substitution in accordance with these Terms.
What your membership includes
Your membership includes the following for the Membership Term:
- access to the Forbes Women Digital Network, hosted on WhatsApp, providing members with a private community for networking, discussions, recommendations, introductions and professional collaboration;
- invitations to four (4) members-only Forbes Women soirées held throughout the Membership Term, subject to RSVP requirements, venue capacity and clauses 12 – 15
- access to Forbes Women editorial features, including a curated collection of news, stories and insights highlighting Australia’s leading women, innovators and changemakers;
- a one-year Forbes Australia Premium Subscription, currently valued at $299 AUD, comprising:
- unlimited digital access to Forbes Australia at forbes.com.au; o the weekly newsletter from the Forbes editorial team; o a one-year print magazine subscription comprising six (6) issues, with each new issue delivered to your nominated Australian mailing address approximately every two months;
- the Editor-in-Chief’s top picks and curated content;
- early access to selected Forbes Australia lists and feature stories, at the Editor-in- Chief’s discretion; and o advanced invitations to selected VIP events and experiences;
- access to exclusive Forbes Women member benefits, including;
- invitations to selected Forbes partner events;
- priority or pre-release ticket opportunities;
- partner offers;
- gifts; and
- other exclusive experiences, where available.
Your Membership may also include additional member communications, networking opportunities and other benefits introduced by Forbes during the Membership Term. Benefits other than the guaranteed inclusions above are subject to availability, event capacity, partner participation and operational requirements and may vary from time to time.
3. Magazine
We will post six issues of Forbes Australia magazine to you during the Membership Term. You must give us a current delivery address and keep it up to date. Delivery is within Australia only, and overseas delivery is not available. Delivery follows our publishing schedule and ordinary postal timeframes, and we do not guarantee specific delivery dates. If an issue arrives damaged or does not arrive, we will arrange a replacement on reasonable notice. We may change the magazine’s format, including moving it to digital, or change its frequency during the Membership Term, provided we offer you a reasonable equivalent. If you do not consider the alternative to be a reasonable equivalent, you may cancel your membership and receive a pro-rata refund of the Fees for the unused part of the Membership Term by giving us written notice within 30 days of our notice of the change.
4. Website and digital content
Your Premium Subscription gives the named Member personal access to subscriber content. You must keep your login details secure and must not share them. You must not copy, scrape, redistribute or commercially exploit the content. We may change, update or remove content, and the platform may be unavailable from time to time for maintenance or for reasons beyond our control, so we do not guarantee uninterrupted access. Your access to subscriber content ends when your membership lapses or is cancelled. Where the Premium Subscription is also governed by our standard subscription terms, those terms apply, and these Terms prevail to the extent of any inconsistency.
5. Acceptance and authority
By completing the Online Purchase, you confirm that:
- the information you provide is true, accurate and complete;
- you are purchasing the Membership for yourself and are the individual named in the membership registration;
- you have read and agree to these Terms; and
- you authorise Forbes Australia to process the applicable Membership Fee using the payment method selected during the Online Purchase.
Your Membership will only be activated once your payment has been successfully processed as part of the Online Purchase. Confirmation of your Membership and purchase will be sent to your nominated email address.
6. Fees and payment
The Membership Fee is the fee displayed on the Forbes Australia website at the time of your Online Purchase, as confirmed in your purchase confirmation. Unless otherwise stated, the Membership Fee is inclusive of GST.
The Membership Fee is payable in full at the time of the Online Purchase. Your Membership will not be activated until your payment has been successfully received.
Payment may be made using the payment methods made available during the Online Purchase process. Any applicable payment processing or card surcharge will be disclosed to you before payment is processed.
If a payment is declined, reversed or otherwise unsuccessful, Forbes may suspend or cancel your Membership and any associated access or benefits until payment is successfully received.
For existing Members, where automatic renewal applies under clause 8, the applicable renewal fee will be charged to your nominated payment method in accordance with clause 8.
7. Term, renewal and charge
Membership continues for the Membership Term and will automatically renew for in accordance with the terms or the subscription you select as part of your Online Purchase as stated on our website unless cancelled before the renewal date. By purchasing a Membership, you authorise Forbes Australia to charge your nominated payment method for the applicable renewal fee at the commencement of each renewal term.
We will provide advance notice before your Membership renews. Renewal Fees may change from time to time. Where renewal Fees change, we will notify you before your renewal date.
You may cancel automatic renewal at any time before your renewal date by contacting Forbes Australia or through any member self-service process we make available. If payment cannot be processed, Forbes may suspend or terminate Membership until payment is successfully received.
8. Cancellation and refunds
Fees are non-refundable once paid, except where a refund is required under the ACL, where these Terms provide for one, or where we agree otherwise in writing.
If we cancel your membership, or fail to provide it, for reasons that are not your fault or that do not amount to a breach of these Terms, you are entitled to a pro-rata refund of the Fees for the unused part of the Membership Term.
If you cancel your membership after activation for any reason other than a breach by us or a right conferred by these Terms or the ACL, access to benefits ceases on cancellation and you are entitled to a refund determined on a pro-rata basis for the unused part of the Membership Term.
Where we cancel your membership for your breach of these Terms under clause 10, any refund will be determined on a pro-rata basis for the unused part of the Membership Term, less any loss or damage we suffer as a result of the breach. We will not retain more than is necessary to compensate us for that loss or damage.
9. Conduct and acceptable use
Forbes may refuse or revoke membership for conduct that is inappropriate, unlawful or damaging to the Forbes brand or its community, and may remove a Member from an event where behaviour is inconsistent with professional standards. Before revoking for conduct that can reasonably be remedied, we will give you notice and a reasonable opportunity to address it, unless the conduct is serious or unlawful.
The use of illicit substances and any criminal activity at Forbes Women events are strictly prohibited and will result in immediate cancellation of membership with no refund.
10. Confidentiality and member information
Forbes Women is a private network. You must keep confidential the personal and business information of other Members that you learn through Forbes Women, and you must not use Member contact details or Forbes Women channels to market to, solicit, or harvest data from other Members without their consent. We may remove or revoke the membership of a Member who breaches this clause.
We may operate member groups and channels, including messaging groups such as WhatsApp. By taking part, you agree to follow the Forbes Women’s group guidelines and these Terms, including the confidentiality and non-solicitation requirements in this clause. We may moderate any channel, and may remove you from it or revoke membership, for conduct that breaches the guidelines or these Terms.
11. Event availability and changes
Attendance at events is subject to capacity limits, RSVP requirements, venue terms, and speaker and partner availability. We do not guarantee access to any specific event or speaker. Forbes Women events are held at various locations across Australia and may not take place in your home city, and you are responsible for your own travel and accommodation to attend them. Where we change or cancel an individual event, this does not affect the guaranteed inclusions in clause 3, and clause 15 applies to events affected by matters beyond our control.
The Forbes Women soirées referred to in clause 3 are reserved for the named Member. If you do not attend an event you have been offered or have registered for, your place for that event is forfeited. It is not carried over, credited or exchanged. This does not apply where we cancel or do not hold the event, in which case clauses 9 and 15 apply. If you are unable to attend due to serious illness, injury or other compassionate circumstances, and you provide us with reasonable prior notice in writing before the event, we may, at our sole discretion, seek to provide you access to an alternative event or benefit during the Membership Term. We are not obliged to do so and no refund is payable for a missed event.
12. Guests
As a general rule, guests are not permitted at Forbes Women events. From time to time an event invitation may offer you the opportunity to bring a guest, and where it does, the invitation will say so. Except where an invitation states otherwise, invitations are personal to you and are not transferable.
13. Event photography and recording
Forbes Women events may be photographed, filmed or recorded. By attending, you consent to being photographed, filmed or recorded, and to Forbes using that material in connection with the Membership and its marketing. If you tell us you do not wish to appear, we will take reasonable steps to accommodate that.
14. Force majeure
We are not in breach of these Terms, and are not liable, for any delay or failure to provide a benefit caused by events beyond our reasonable control, including natural disaster, pandemic, government action, or venue or partner failure. Where such an event prevents us from providing a guaranteed inclusion for a material part of the Membership Term, we will offer a reasonable alternative or a pro-rata refund for the affected inclusion.
15. Privacy and data
Member data is collected and processed in accordance with the Forbes Australia Privacy Policy, and may be used for membership administration, event communications, subscription delivery and member experience. Data will not be sold to third parties.
Members acknowledge that participation in the WhatsApp community may make their mobile number, profile photo, display name and other information visible to fellow Members.
16. Marketing communications
By becoming a Member you consent to receive Forbes Women communications, event notifications and membership updates. Commercial electronic messages will include an unsubscribe facility, and you may opt out of non-essential communications at any time. Essential communications about your membership and billing will continue while you are a Member.
17. Your rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL that cannot lawfully be excluded or limited. Our goods and services come with guarantees that cannot be excluded under the ACL.
To the extent permitted by section 64A of the ACL, and only where the supply is not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for failure to comply with a consumer guarantee is limited, at our option: for services, to supplying them again or paying the cost of having them supplied again; and for goods, to replacing or repairing them, supplying equivalent goods, or paying the cost of doing so.
18. Limitation of liability
To the maximum extent permitted by law, Forbes accepts no liability for any indirect, incidental or consequential loss associated with membership. Subject to clause 20 and to liability that cannot be limited by law, our total liability to you in connection with your membership is limited in aggregate to the Fees paid by you in the 12 months before the event giving rise to the claim.
Forbes maintains public liability insurance for its events, and nothing in these Terms limits liability for death or personal injury to the extent it cannot be limited by law.
19. Member indemnity
You agree to indemnify Forbes against loss or damage we suffer to the extent it is caused by your breach of clause 11 (confidentiality), or by your unlawful conduct in connection with your membership that causes or is reasonably likely to cause loss to Forbes. This indemnity is limited to loss that is a reasonably foreseeable result of the breach or conduct, does not apply to the extent the loss was caused by us, and is subject to the aggregate liability cap in clause 19 and to the ACL. Forbes must take reasonable steps to mitigate its loss before making a claim under this indemnity. Before making a claim under this indemnity, Forbes will give you reasonable written notice of the claim, including reasonable particulars of the loss.
20. Amendments
We may make minor or administrative changes to these Terms at any time. A minor or administrative change is one that corrects an error, updates contact details or references, reflects a change required by law, or is otherwise unlikely to affect your rights or benefits. We will not make a change that materially reduces your guaranteed inclusions under clause 3, increases your Fees, or otherwise materially reduces your rights or benefits during your Membership Term, except on at least 30 days’ prior written notice. Where such a change has a material adverse effect on you, you may cancel your membership and receive a pro-rata refund of the Fees for the unused part of the Membership Term by giving us written notice within 30 days of our notice of the change.
21. Assignment
You may not assign or transfer your rights under these Terms. We may assign or novate our rights and obligations to a related entity or successor on written notice to you, provided the assignment does not materially reduce the quality or scope of your membership benefits. If an assignment materially reduces your benefits, you may cancel your membership and receive a pro-rata refund of the Fees for the unused part of the Membership Term.
22. Notices
Notices under these Terms may be given by email to the address each party has provided, and are taken to be received on the next business day after sending.
23. Dispute resolution
If a dispute arises, the parties will first try to resolve it by good-faith discussion. If it is not resolved within 20 Business Days, the parties will refer it to mediation in Sydney before starting proceedings, except where urgent relief is needed. Consumer claims may also be dealt with by NSW Fair Trading or the NSW Civil and Administrative Tribunal.
24. Entire agreement and order of precedence
These Terms form the entire agreement for your membership and replace any earlier understandings that had been agreed. To the extent that there is any inconsistency with any existing agreement, these Terms will prevail for all commercial matters.
25. Severability
If any provision of these Terms is found to be unfair, void or unenforceable, it is severed and the remaining provisions continue in force.
26. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales.
