Terms and Conditions for Memberships

These are the standard terms and conditions that apply to your subscription to Success Publishing Pty Ltd print and digital magazine published under the name and style of ‘Forbes Australia’ and other services and entitlements. Any reference in these terms and conditions to ‘We’, ‘Us’ or ‘Success Publishing Pty Ltd’ is a reference to ‘Forbes Australia’.

Ensure you read the terms and conditions specific to your subscription before making payment for any subscription. Once your payment has been processed, you are deemed to have accepted each of the terms and conditions, as amended from time to time, and your payment becomes non-refundable.

1. Your Subscription

(a) We offer three types of membership plans:

(i) Essential: Includes: 1-year unlimited Digital subscription to forbes.com.au, weekly newsletter from the Forbes editorial team. Payment Term: Monthly at $25/month AUD (billed monthly) or Annual at $199AUD (billed annually);

(ii) Premium Includes: 1-year unlimited Digital subscription to forbes.com.au, weekly newsletter from the Forbes editorial team, 1 year print magazine subscription (6 issues) with each new issue delivered to your nominated mailing address every 2nd month, Editor-in-Chief’s top picks and curated content, early access to iconic Lists and feature stories at the Editor’s discretion and advanced invitations to VIP events and experiences. Payment term: Prepaid Annual at $299 AUD (billed annually)

(iii) Forbes Women includes: 1-year Premium subscription as noted in point (ii) valued at $299, an invitation to attend 4 x quarterly soirees held by Forbes Australia, a monthly curated newsletter highlighting Forbes Women feature content and businesses, and a numbered membership status between 1 and 100. Total cost for annual membership is $697, billed annually.

(b) Forbes Australia and any of its related companies may require that users of our digital services become a registered user and create an account to access any such service or any other of our offerings from time to time. 

(c) To subscribe to a membership plan, you must complete the online registration form and pay the relevant membership fee.  We reserve the right to reject any application for subscription. Confirmation of acceptance will be provided to you via your nominated email address.

(d) You may pay by credit card or debit card at the time of subscription. If you pay by credit card, we may add a credit card surcharge (currently 0.5% but subject to annual review) which reflects the cost to us of processing your acceptance and payment.   

(e) Subscription fees are not refundable except in the circumstances expressly set out in these terms and conditions. 

(f) We are not responsible and have no liability for any claim relating to any loss to you arising from you having entered incorrect contact details in your subscription process. It is your responsibility to report any errors to us as soon as you become aware thereof.  In our absolute discretion, we may provide you with a credit to mitigate any such loss, which credit may (at our election) take the form of an extension to your subscription period or a reduction in the price of your next subscription payment.

(g) Your subscription affords you the entitlements described in your relevant membership plan for the duration of your subscription period, upon expiry of which your entitlements will cease.  

(h) Your subscription is for your personal use only. You are not permitted to use your subscription for any commercial purpose, including to on-sell your subscription to any third party. If you wish to obtain a multiple user subscription, you may qualify (and must apply) for a corporate subscription. Please enquire from our Corporate Team for more information corporate@forbes.com.au.

(i) Note that your subscription will not terminate at the end of your subscription period but will automatically renew for the same period at the end of each billing cycle (i.e. month on month or year on year).  On the last date of a subscription period, you will automatically be charged for the next subscription period unless you have given prior written notice to cancel your subscription (see section 5). 

(j) It is also your responsibility to check your credit card and bank account statements to make sure that the correct amounts are being debited from your account and to let the Concierge Team know if you believe you are being billed incorrectly.  We will not refund past subscription payments if you did not contact our Concierge Team to report unexpected deductions from your nominated credit card or bank account within 3 months of date of the relevant deduction.

(k) We may change the frequency of issue or our pricing and fees at any time. We will give you at least 14 days’ notice if frequency is increased or the new price is greater than the price payable by you at the commencement of your current subscription period. If you have a fixed term subscription, the increased frequency and/or new price will be shown in your renewal notice. If you have an auto-renew subscription, the increased frequency and/or new price will be notified to you by email. 

(l) Any increase in frequency or price will apply with effect from the next billing date after notice of such increase. If you cancel your subscription (not less than 7 days) before the next billing date, then the increase in frequency or price will not affect you (see section 5 below).

(m) We will not be liable to you for any loss or damage that you or any other person may incur in connection with your subscription, whether direct, indirect, consequential or otherwise. Furthermore, our maximum liability to you directly or indirectly in relation to your subscription is limited to the amount that is equal to the aggregate subscription fees paid by you to us in the 12-month period immediately preceding any claim.

2. Conditions of Access

(a) You will be entitled to receive the benefits of your membership package and any relevant online access once your application for subscription and the appropriate payment has been received and accepted by us (Registered Access).   Confirmation of payment and acceptance will be provided to you by notice to your nominated email address. 

(b) A username and password is assigned to a single user only and to no more than three devices concurrently.  You must ensure that your username and password remain secure.

(c) You are responsible for all use, activities and charges associated with your username and password. Your username and password are not transferable (to another user).

(d) Your Registered Access may be used for non-commercial purposes only.

(e) You must contact Forbes Australia if you become aware that unauthorised use of your username and password has occurred. Forbes Australia may take appropriate action, such as terminating registration if you are deemed to have shared your password outside your household or have allowed unauthorised use of your username and password.

3. Content

(a) We reserve the right to modify the content, inclusions, type and availability of any digital product at any time. We also reserve the right to enable free access to part or all of our magazines, periodicals, other content and services from time to time and you will not be entitled to any refund (whether full or partial) of your subscription fees if we do this.

(b) You acknowledge and agree that some of our content may be geographically restricted and accordingly may not be viewable or accessible from outside Australia.  There may also be other technology or infrastructure related reasons which limit your ability to access our content at any time. You will similarly not be entitled to any refund (whether full or partial) of your subscription fees in such instances.

4. Managing your subscription and account

(a) You can manage your account, change your personal details in the ‘MyForbes’ section of our customer portal or by contacting the Concierge Team via info@concierge.forbes.com.au for help.

(b) Upgrades may not be done online. You may upgrade your membership package at any time by contacting the Concierge Team via info@concierge.forbes.com.au.    However, unless any upgrade is paid for immediately, any change will only take effect from your next billing cycle   . If you have a print product, we will need up to 10 working days to make the change to your home delivery.

(c) You are responsible for making sure your delivery and payment details are always valid and up to date – you can do this online – visit MyForbes or contact the Concierge Team via info@concierge.forbes.com.au.

5. Cancellation and Termination

(a) You may request cancellation of your subscription by contacting our Concierge Team via the ‘MyForbes’ concierge portal or via info@concierge.forbes.com.au  Cancellation will not be effective until we have received all relevant information from you and will not take effect until the end of your current billing cycle.  Note, to be effective, your cancellation request must be made and received by us at least 72 hours (for monthly subscriptions) or 7 days (for annual subscriptions) before your next subscription payment is due.

(b) In our discretion (acting reasonably), we may cancel or suspend your subscription at any time, such as any payment due by you being declined or if you otherwise breach any of these terms and conditions or for any other appropriate cause. If we cancel your subscription, we may give you a prorated refund provided you have pre-paid your subscription in full.  It should be noted that opting out of receiving newsletters or any other email communication otherwise related to your subscription will not constitute cancellation of your subscription.

(c) Irrespective of the reason for early termination of your membership, you will not be entitled to a refund in respect the unexpired portion of your subscription period but will continue to enjoy all benefits under your membership plan until your subscription terminates

(d) We are not responsible for any missed or unwanted deliveries or any unexpected charges resulting from requests made by you to any newsagency or other third party rather than directly to our Concierge Team.

6. Privacy

(a) You acknowledge and agree that certain personal information (which may include your name, address, email address, year of birth, postcode and mobile/telephone) number may be collected and stored by us and, amongst other things, used to manage your subscription, communicate with you about your subscription and to notify you of any associated customer offers or benefits, future subscriptions and/or other goods and services that we consider you may be interested in, unless you specifically opt out of these communications by checking the appropriate ’opt out’ box.

7. Data Security

Forbes Australia strives to ensure the security, integrity and privacy of personally identifiable information of our customers. We use a variety of physical and electronic security measures including restricting physical access to our offices and firewalls and secure databases to keep personal information secure from misuse, loss or unauthorised use or disclosure. No data transmission over the Internet or storage can be guaranteed to be totally secure.

8. Intellectual Property

(a) All intellectual property in relation to content on the Forbes Australia website (the Website) and any website belonging to Forbes Australia or any of its related companies) belongs to Forbes Australia or its related company, licensor(s), advertisers or affiliates. You obtain no interest in that intellectual property. All content on the Website is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the content.

(b) You may download and view content or print a copy of material on the Website for personal, non-commercial use provided you do not modify the content in any way (including any copyright notice). All rights not expressly granted under these terms of use are reserved by Forbes Australia. Unless expressly stated otherwise, you are not permitted to copy, or republish anything you find on the Website without the copyright or trademark owners’ permission.

(c) Unless otherwise indicated, the logos on the Website and the logos on any other digital or paper media published or issued by us from time to time are registered trademarks of Forbes LLC used under license from Forbes LLC. Other trademarks may be displayed on the Website from time to time. These may belong to Forbes Australia or to third parties. Nothing displayed on the Website should be construed as granting any licence or right of use of any logo, trademark or masthead displayed on or within the Website, without the express written permission of the relevant owner.

9. Liability & Indemnity

Forbes Australia does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act 2010 (ACL) which cannot be excluded, restricted or modified. However, Forbes Australia excludes all other rights, remedies, guarantees, conditions, and warranties in respect of your Registered Access, any membership or subscription or this Website, whether based in statute, common law or otherwise to the extent permitted by law. To the fullest extent possible and subject to Forbes Australia’s liabilities and obligations under the ACL:

(a) Forbes Australia and its related entities do not warrant the accuracy of the content on the Website. The content is provided to you “as is” and on an “as available” basis and on the condition that you undertake all responsibility for assessing the accuracy of the content and rely on it at your own risk;

(b) All content on the Website may be changed at the sole discretion of Forbes Australia and its related entities without notice except that if Forbes Australia materially changes the content which you access through your Registered Access or any membership or subscription so that the breadth or nature of the service you receive is materially altered, Forbes Australia will take the steps as described in these terms to notify you of those changes, where practicable.

(c) Forbes Australia and its related entities will have no responsibility or liability in relation to any loss or damage that you incur, including damage to your software or hardware, arising from your Registered Access, any membership or subscription, any membership to our digital services or your use of or access to this Site or any Website.

(d) Forbes Australia and its related entities do not warrant that functions contained in the Website, such as hyperlinks, will be uninterrupted or error free, that defects will be corrected or that Forbes Australia or the server that makes it available, are free of viruses or bugs.

10. Delivery of magazine

Your Forbes Australia Magazine is included in the Premium Membership and will be delivered within 60 days of the commencement of your membership. The Magazine will be mailed to the postal address listed in your ‘MyForbes’ portal. Please ensure this is your correct postal address. Premium members will receive the magazine every 2 months (we are a bi-monthly magazine).

11. Events       

(a) When using your one bonus free pass to the Forbes Australia virtual event, you agree to adhere to the terms and conditions relating to the event.  

(b) The bonus free pass will need to be activated by redeeming your unique code, located in your ‘MyForbes’ portal.

(c) The unique code can only be used once & will expire after 12 weeks has elapsed from the start date of your membership.

(d) The bonus free pass to the Forbes Australia virtual event is unable to swapped, exchanged or re-sold.
